Sabinsa is now the sole owner of the Boswellin trademark in the European Union, of which the Czech Republic is a member.
The Czech Patent Office in the matter of Czech trademark Boswellin No. 270659 (owner: Orling s.r.o) rejected the appeal of the Orling and confirmed their initial decision, declaring the trademark invalid.
The sequence of events leading up to this decision include: Sabinsa objecting to Orling's Boswellin Trade Mark in the Czech Republic by filing an invalidation of the trademark with CZ Patent office, after which the patent office granted the invalidation in Sabinsa's favor. Orling appealed against this invalidation, Sabinsa gave the response to the statement of appeal after which Orling's appeal was turned down by the Czech Patent office and the trademark was declared invalid.
"Time after time Sabinsa is vindicated by our efforts to protect our intellectual property," said Sabinsa founder Dr. Muhammed Majeed. "We would truly prefer to see those companies put the same effort into developing their own intellectual property rather than ride on our coat tails."
Sabinsa Corporation was recently awarded damages for Creative Compound's ForsLean® trademark infringement by the US District Court of New Jersey in which the infringing company was ordered to disgorge its profit of $139,388.40 from their sales of the infringing product and to pay those disgorged profits to Sabinsa.
